Eternal Crane is music lessons with a spiritual teaching, made and run by Joseph Malicke (joEy). These terms cover the site, eternalcrane.com, and everything you get from it, free or paid. By using the site, or buying anything from it, you agree to them. If you don’t agree, please don’t use it.
The work is joEy’s
Eternal Crane’s lessons, studies, improvisations, clips, courses, sheet music, charts, recordings, pictures and designs, and the words on this site, are Joseph Malicke’s work, copyright Joseph Malicke, unless they say otherwise. The name Eternal Crane, its crane and its logo are his too.
What you’re welcome to do
Watch, listen and learn. Practise what the lessons teach. Link to any page, and share the links anywhere you like.
What needs joEy’s permission
Everything else, and in particular: re-uploading, re-posting, copying or selling the videos, recordings, files, designs or words; passing them off as your own; copying the site or collecting its contents by script; and using any of it to train or feed an AI model. To ask, write to joEy through the Contact form.
Using the site fairly
Please don’t try to break, overload or get around any part of the site, its sign-in or its checkout; don’t use its forms to spam, harass or deceive anyone; and don’t use someone else’s email or card. joEy may block anyone, or close any account, that does, and may refuse service to anyone for any lawful reason.
Your account
A free account is your email alone, and signing in proves you can read it, so keep your email account safe. You can delete your account whenever you like. joEy may change or end the free accounts, or what they unlock, at any time.
What you send joEy
What you send through the site (a question, links, files, a piece to learn) stays yours. By sending it, you confirm you have the right to, and you let joEy use it to answer you and to do what you asked. Please don’t send anything you don’t want him to read.
Buying from the Store
Prices are in US dollars. Tax and shipping, where they apply, are shown at the checkout before you pay. You pay on Stripe’s secure checkout; some digital items are sold through Link, by Stripe, as their seller, and Link’s own terms apply to those too. An order is accepted once it is paid. joEy may decline or cancel an order (a price shown by mistake, an item no longer made, an order that looks like fraud) and refund whatever was paid for it. What the Store sells, and its prices, can change at any time. Pictures show each item as closely as a screen can; colours on yours may differ a little.
Digital things
Sheet music, charts, videos, courses and other downloads, free or paid, are licensed to you, not sold: you may keep them, play, practise and teach from them, on your own screens and on paper you print for yourself. You may not share the files, post them, sell them, or give your access to anyone else. Because a digital item is yours the moment it’s delivered, its sale is final once you can download or open it, unless the law where you live says otherwise. joEy keeps downloads working as well as he can, but can’t promise any file or page will be there forever, so keep a copy of what you download.
Subscriptions
A subscription renews by itself, charging your card at the start of each period (each month, unless its page says otherwise) until you cancel. You can cancel any time; it stops renewing, and what you’ve paid for stays open until the end of that period. A period already started isn’t refunded, in whole or in part. joEy may change what a subscription includes; a new price applies only from your next period after he tells you, so you can cancel before it does.
Things that ship
Shirts and other goods are made to order by a print partner, then shipped to you. Delivery times are estimates, not promises. Each item is yours, and its risk of loss passes to you, once it’s handed to the carrier. Please check your address at the checkout: an order sent to an address you gave is delivered, and an order returned for a wrong or incomplete address can be sent again at your cost. Duties and import taxes outside the United States are yours to pay. Because each item is made for you, it can’t be returned or exchanged for its size, its colour or a change of mind. If it arrives damaged, defective or misprinted, write to joEy through the Contact form within 30 days of delivery, with a photo, and he’ll replace it or refund it, as he chooses.
Refunds and going further
For any problem with an order, please write to joEy through the Contact form before disputing the charge with your bank: he can put most things right faster than a dispute can. joEy may give a refund, a replacement or a credit beyond what these terms promise whenever he chooses to. Doing so once doesn’t change these terms, or promise the same another time.
Lessons and sessions
The lessons, studies, courses and private sessions are teaching and personal coaching, in music and in spiritual life; a shamanic reading is a spiritual practice, for reflection, not a prediction. None of them is medical, mental-health, financial, legal or other professional advice; for those, see someone qualified. No particular result is promised. A private session’s time and rate are agreed with joEy when you book it.
Cancelling a paid session
To cancel or move a paid session, tell joEy at least 24 hours before it starts, and you get a full refund or a new time. A session cancelled with less notice, or missed, isn’t refunded. If joEy has to cancel, you choose a new time or a full refund.
No warranty
The site and everything on it or from it, free or paid, are offered as they are and as available, with no warranty of any kind beyond what the law requires, including any that it is fit for a particular purpose, accurate or uninterrupted. A page may have a mistake, and the site may change or be offline at times.
Limits on liability
As far as the law allows, joEy and Eternal Crane aren’t liable for any indirect, incidental, special or consequential loss, or for lost profits, data or goodwill, from your use of the site or anything from it, even if told it might happen. Their whole liability for any claim is limited to what you paid joEy in the 12 months before it, or fifty US dollars if you paid nothing. Where the law doesn’t allow a limit like these, it applies as far as the law does.
If a claim comes from what you do
If someone makes a claim against joEy or Eternal Crane because of how you used the site, what you sent, or your breaking these terms, you agree to cover the cost of it, reasonable lawyers’ fees included.
Disagreements
If you and joEy disagree about anything here, write to him through the Contact form first, and give him 30 days to work it out with you. If that doesn’t settle it, it is settled in the state or federal courts in Tennessee, and you agree to them. Each of us brings a claim only for ourselves, never as part of a class or group action, as far as the law allows, and within one year of when it arose.
Other sites
YouTube, TikTok, Discord, Stripe, Link and the print partner have their own terms, which apply when you use them. What the site does with what you send is on the privacy page.
The law that applies
These terms are governed by the laws of the State of Tennessee, in the United States.
The rest
These terms, the privacy page and what a checkout shows when you buy are the whole agreement between you and joEy. If a part of them can’t be enforced, the rest still stands. joEy not insisting on a term once doesn’t give it up. He may pass these terms to whoever carries Eternal Crane on; you may not pass yours to anyone.
Changes and questions
These terms may change, and the date at the top says when they last did. A change applies from that date; an order already paid keeps the terms of its day. Using the site after a change means you accept the new terms. For any question, write to joEy through the Contact form.
